Privacy Notice on the Processing of Applicant Data pursuant to Art. 13, 14 and 21 of the General Data Protection Regulation (GDPR)

Thank you for your interest in our company. In accordance with Art. 13, 14 and 21 of the General Data Protection Regulation (GDPR), we inform you on this page about the use of the personal data you provide during the application process, as well as your rights in this regard. To ensure that you are fully informed about the collection and use of personal data during the application process, please take note of the following information.

1. Who is responsible for data processing, and who is the Data Protection Officer?

2. Purposes and legal basis of the processing

We process your personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on establishing an employment relationship with us. The legal basis for this is Section 26 of the (new) BDSG, and, where applicable, Art. 6(1)(b) GDPR for the initiation or performance of contractual relationships.
Furthermore, we may process personal data about you insofar as this is necessary to defend against legal claims asserted against us arising from the application process. The legal basis for this is Art. 6(1)(f) GDPR; the legitimate interest is, for example, a duty of proof in proceedings under the German General Act on Equal Treatment (AGG).
Should an employment relationship be established between you and JUMiNGO, we may, pursuant to Section 26(1) BDSG, continue to process the personal data already received from you for purposes of the employment relationship, insofar as this is necessary for the performance or termination of the employment relationship, or for the exercise or fulfillment of rights and obligations arising from a law, a collective bargaining agreement, or a works or service agreement (collective agreement) of employee representation.

3. Categories of personal data

We process data related to your application. Personal data includes, in particular, your contact details (such as first name, last name, titles, private address, phone number, email address), as well as further data on your career history (e.g., CV, qualifications, degrees, and professional experience) and your person (e.g., cover letter, personal interests). This may also include special categories of personal data (e.g., information on a severe disability).
Your personal data is, as a rule, collected directly from you during the application process and encrypted during electronic transmission. The data originates from the online application form, from uploaded files, or from documents sent to us by email. We also process personal data that we have lawfully obtained from publicly accessible sources (e.g., professional networks).
In accordance with Art. 13(2)(e) GDPR, we are required to inform you that you are not obligated to provide us with your data. However, without your data, we are unable to include you in the application process.

4. Who receives your data?

Within our company, only those persons and departments receive your personal data who require it for the hiring decision and to fulfill our contractual and legal obligations. In addition, we may transfer your personal data to other recipients outside the company, insofar as this is necessary for establishing the employment relationship.

5. Duration of data storage

We store your personal data for as long as necessary to decide on your application. Your personal data and application documents will be deleted no later than six months after the application process has ended (e.g., after notification of a rejection decision), unless longer storage is legally required or permitted. We otherwise store your personal data only insofar as this is legally required or, in a specific case, necessary for the assertion, exercise, or defense of legal claims for the duration of legal proceedings. Should you have consented to a longer storage period for your personal data, we will store your personal data in accordance with your declaration of consent.
If an employment, training, or internship relationship results from the application process, the data will, insofar as necessary and permissible, continue to be stored and subsequently transferred to your personnel file. Following an application process, you may receive an invitation to join a talent pool. This allows us to consider you for future suitable vacancies as well. With your consent, we will store your application data in our talent pool in accordance with your consent or any future consent you may provide.

6. How do we transfer data to countries outside the EU?

Should we transfer personal data to service providers outside the European Economic Area (EEA), such transfer will only take place if the European Commission has confirmed an adequate level of data protection for the third country in question, or if other appropriate data protection safeguards are in place (e.g., binding corporate rules or the European Commission's standard contractual clauses). Detailed information on this, as well as on the level of data protection at our service providers in third countries, can be requested using the contact details provided above.

7. Your rights

Every data subject has the right to access under Art. 15 GDPR, the right to rectification under Art. 16 GDPR, the right to erasure under Art. 17 GDPR, the right to restriction of processing under Art. 18 GDPR, the right to notification under Art. 19 GDPR, and the right to data portability under Art. 20 GDPR.
You furthermore have the right to lodge a complaint with a data protection supervisory authority under Art. 77 GDPR if you believe that the processing of your personal data is unlawful. This right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.
Insofar as the processing of personal data concerning you is based on Art. 6(1)(f) GDPR for the protection of legitimate interests, you have the right to object at any time to the processing of this data for reasons arising from your particular situation. We will then no longer process this personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves to assert, exercise, or defend legal claims. 8. Are you obligated to provide your data?

The provision of personal data as part of the application process is neither legally nor contractually required. You are therefore not obligated to provide personal data. However, providing personal data is necessary for a decision to be made on an application or on entering into an employment contract with us. When applying, you should only provide such personal data as is necessary for the submission and processing of your application. If you do not provide us with any personal data as part of an application, we will not be able to make a decision on establishing an employment relationship.

9. Automated decision-making

The decision on your application is not based solely on automated processing. Accordingly, no automated decision-making in individual cases within the meaning of Art. 22 GDPR takes place.
